I have the following task, and I need some help getting started: Write a 800 words discussing an employment matter currently being dealt with in the courts or a tribunal. Be sure to address the following areas:1) Must discuss the relevant law, how that body in question obtained jurisdiction and the legal basis for the relationship between the parties. 2) The fact pattern must be real and the issues must arise from real world problems. You may choose a newspaper article or use a real life example from your work or life and be prepared to prove the authenticity of the facts.I chose the case of CBOSCS vs. Humphries. This is a Supreme Court case that was ruled on in May of 2008 but the affects of this ruling has changed discrimination lawsuits forever.
I thought this case would be an excellent learning experience for you and your class. The case is current enough and the ruling will bring the Humphries case back to its original district court.In 2007, the Supreme Court heard what is referred to a sleeper case. Employee, Lily Ledbetter, lost her right to sue her company due to the fact the first time that her pay had been docked, due to sex discrimination. Ledbetter went to court when she did indeed notice the discrepancy. How does this affect the case I am discussing? In May of 2008, the Court heard another case regarding employment discrimination. This case could disrupt the law and leave some enraged. The case is regarding employees’ rights under one statute.From 1999 through 2001, Hendrick Humpries worked as a Cracker Barrel restaurant manager. When Humpries first began his position with Cracker Barrel, he was excellent. He received raises, bonuses and excellent employee performance evaluations.
