When it comes to the court cases between 1970-1975 involving juveniles and their rights, a lot of had to take into their consideration is their age. Children need to be taken into special consideration when it comes to crimes that were committed. In re Winship case, proof beyond a reasonable doubt during the adjudication proceedings is needed. McKeiver vs Pennsylvania, which was actually three court cases heard together, is a case that states that a trial by jury is denied for juveniles. But there are 10 states in the United States that will grant this. Breed v Jones cannot adjudicate a case and then transfer to the adult criminal case for the same offense. In doing so with these types of cases, it could constitute double jeopardy.
When it comes to these cases and these decisions, it help paved the way for juveniles and protecting their rights. Binding -over is part of a procedural safeguard procedure that takes into consideration of age and maturity of the juvenile, the seriousness of the referral incident, past records, among other things. Juveniles are still not mentally mature enough when it comes to crime and still have a chance of rehabilitation, more so than adults, and safeguards need to be put into place to protect them. “Learn to do good; seek justice, correct oppression; bring justice to the fatherless, plead the widow’s cause.” (ESV Isaiah 1:17).
