The Nurse Professional Liability Exposures: 2015 Claim Report Update was very informative and brought to light many issues that are pertinent to everyday clinical nursing practice. While reading through some of the examples of claims, it was notable that some mistakes were grievous mistakes, such as caring for a patient that was ventilated without proper training on vented patients; other mistakes were common errors that there are systems in place to avoid but by overriding the protective systems, mistakes were made, such as with medication errors. On page 37 of the Report, there is an illustration of a claim against a nurse who was working as a triage nurse on a day a young woman was sent to the Emergency Department from Dialysis to have her hemodialysis catheter site assessed. The nurse assessed the patient correctly, documented appropriately, and reassessed the patient when she found that the patient had not been seen by a provider in the time expected of the triage rating system. The patient was assessed by a provider 90 minutes after being triage by this nurse. The patient was sutured and sent home to follow up the next day. The patient passed away during the night. The nurse did not settle but fought the claim, was defended, and found not responsible. Although the nurse was defended and found to not hold responsibility for the death of the patient, the one item that could have been changed to mitigate the claim would be that the nurse could have pushed to have the patient brought back into the ED to be assessed by a provider within the expected time of 15-60 minutes of triage for a triage level of three, instead of continuing her own assessments in triage.
