I do believe the executive branch has the authority to declare national emergencies and to re-appropriate funds in response to Congressional inaction. I also believe the legislative and judiciary branches have the authority to challenge the President’s actions. Our reading this week illustrated that there is a constant battle to maintain the separation of powers between the three branches of government. The recent declaration of a national emergency regarding border security is a great illustration of how our three branches of government can exercise their authorities to maintain checks and balances on power.

According to the National Emergencies Act of 1976, the President can declare a national emergency and invoke the emergency powers, as defined by law, but Congress can also terminate a declaration of emergency with a joint resolution signed into law (94th United States Congress, 1976). It is also my understanding that a citizen or organization can challenge this declaration in a court of law. A legal challenge can then be appealed all the way up to the Supreme Court where the judicial branch can judge the constitutionality of this emergency declaration along with the legality of the funds being re-appropriated.

Third paragraph: Did Siddhartha ever find atman? Why couldn’t Siddhartha find his atman? Can you ever know if you find atman? What is that experience supposed to be like?Is his project different from the Hindu mystics? How so? Was his project personal? Universal? What conclusion did Siddhartha reach? What is anatman?

Fourth paragraph? Why does Siddhartha think that suffering is due to a mistake? What mistake? In the end, do we really have a self? How does the answer to this question relate to suffering? How does everything relate to nirvana?

Case Study: Malpractice Action Brought by Yolanda Pinellas

Yolanda Pinellas is a 21-year-old female student studying to be a music conductor. She was admitted for chemotherapy. The medication Mitomycin was administered by intravenous infusion through an infusion pump.
During the evening shift the infusion pump began to beep. The RN found that the IV was dislodged and discontinued the infusion, notified the physician and provided care to the infusion site. The patient testified that a nurse came in and pressed some buttons and the pump stopped beeping. She was groggy and not sure who the nurse was or what was done. The documentation in the medical record indicates that there was an infiltration to the IV.
Two weeks after the event, the patient developed necrosis of the hand and required multiple surgical procedures, skin grafting, and reconstruction. She had permanent loss of function and deformity in her third, fourth, and fifth fingers. The patient is alleging that because of this, she is no longer able to perform as a musical conductor.
The risk manager had noted when doing chart reviews over the last 3 months prior to this incident that there were issues of short staffing and that many nurses were working double shifts, evenings, and nights then coming back and working the evening shift. The risk manager also noted a pattern of using float nurses to several units.
